ONE: Identification of the parts

The present general conditions regarding the use of the portal www.cocosuites.com (hereinafter referred to as the PORTAL), are endorsed in part by THINK LAB, S.L (hereinafter referred to as THINK LAB); with registered address in C/ Provenza 540, 6o2a 08025 Barcelona, Spain, VAT number B65250540, and inscribed on the Registro Mercantil de Barcelona (volume 41711, sheet 78, page B-394182, inscription 1, diary 1077, seat 2456). These conditions are also endorsed in part by the USER, that is, any physical or juridical person that accesses the website and that makes use or not of the services offered therein. The USER may apply for a membership by filling in a questionnaire and following the specified steps that will be detailed in a subsequent e-mail. For further information on the “member” status see section FOUR: Membership policy.

In accordance with what is specified in the law on Information Society Services and Electronic Trade 34/2002, dating July the 12th, it is therefore stated that THINK LAB, S.L is the rightful owner of the web domain www.cocosuites.com, www.cocosuites.es, www.cocosuites.net and www.cocosuites.eu.  

TWO: Services offered by THINK LAB

THINK LAB, S.L is a mercantile entity that carries out a series of publicity and marketing activities on and off line, as well as the organisation and development of events, product commercialisation and other derived services for both private companies and individual parties.   

The present general use conditions regulate the generic usage of the PORTAL www.cocosuites.com, therefore, the specific terms regarding the provided services to both users and hotelier entities will be conscribed in accordance to the valid legislation on the matter at the moment.

The PORTAL www.cocosuites.com offers the USER the possibility of accessing and using the different contents and services that are displayed by the entity and/or other providers, such as hotel booking engines in order to make the direct reservation much simpler for the user.

THREE: Access to the offered services.

To access the services offered by the PORTAL it will be necessary to access it through its URL www.cocosuites.com or from external links that are directed to this same URL. The services offered by THINK LAB, S.L or by third parties are subject to availability depending on the USER’S membership status. (See section FOUR: Membership Policies).
 
Fort the correct access and use of the specific contents and services offered by the PORTAL the system requires a series of elements to be properly downloaded and installed beforehand. This installation will be executed by the USER, declining THINK LAB any claims of responsibility on that matter.

The USER submits to and accepts the preset General Conditions merely by visiting and surfing the PORTAL and is the only one to be held responsible for the information provided to the PORTAL. Therefore, the introduction of false, inaccurate or someone else’s information will be exclusively imputed to the USER.

FOUR: Membership Policy

The PORTAL www.cocosuites.com offers a series of services that require a “member” status to be accessed. Previously registered on the site, “members” have different status according to the class and volume of activity they undergo in the PORTAL. The membership policy will be defined by THINK LAB and is subject to modifications at any point without previous notifications on THINK LAB’s part.

THINK LAB, S.L reserves the right to cancel a user’s “member” condition considering any violation or non-fulfilment of the USER’S obligations regarding the site’s use conditions defined in this document and stipulated by the law (see disposition SIX: Usage Obligations).

FIVE: Price Policy

The PORTAL www.cocosuites.com merely informs about the range of prices of the stipulated products and services commercialized by third parties. THINK LAB is not to be held responsible for the accuracy of these, being these shown for informative and orientating purposes only and do not constitute any kind of specific offer.

SIX: Usage Obligations

The USER promises to use the PORTAL and its services in accordance to the actual law, good manners, morality a public order. Regarding the actual law on Information Society Services and Electronic Trade 34/2002, dating July the 12th, it is absolutely forbidden to enter contents or comments that in any way attempt against:   

• The Safeguarding of public order, criminal investigation, public security and/or national defence.

• The protection of public health or physical peoples that act as consumers or users, or even when they act as investors.

• A person’s right to respect and dignity and the principle of no discrimination on matters of race, sex, religion, sexual orientation, opinion, nationality, disabilities, or any other personal or social circumstance.


• The protection of youngsters and children.

The USER promises to abstain from using the PORTAL and the services therein offered with illegal means or effects that are contrary to the dispositions established in the General Conditions section. The USER will also abstain from other forms of misuse such as the violation of rights and interests of third parties or any other kind of usage that may lead to damage, render useless, deteriorate make inoperative, or impede the normal use of the PORTAL and its services for other users.  

Any kind of infraction of the accepted obligations on the USER’S part will enable and allow THINK LAB to interrupt the service. Furthermore, if THINK LAB has proof or knowledge of these infractions or pernicious stored information these will be immediately reported to the local and competent authorities in accordance with the law on Information Society Services and Electronic Trade 34/2002, dating July the 12th.   

SEVEN: Denegation of PORTAL access and services.

THINK LAB reserves the right to refuse or revoke access to the PORTAL and/or to its services at any moment and without previous notice to those users that do not abide by the website’s General Conditions and/or infringe the law on Information Society Services and Electronic Trade 34/2002, dating July the 12th.

EIGHT: Correct use of the site’s contents

The USER promises to use the contents in a diligent, correct and legit manner and also agrees to abstain from:

• Using the contents with finalities, means or effects contraries to the law, morals and the good manners commonly accepted by the public order.

• Reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the contents; with the exception of previous authorisation of the owners of the legitimate rights or the eventuality of it being legally permitted. 
  

• Deleting, eluding o manipulating the copyright and other identifying data regarding THINK LAB’S and their owner’s rights, as well as the site’s protection technical devices or any other information mechanism that the contents may contain.   

THINK LAB doesn’t control or guarantee the absence of viruses or any other elements in the contents that may produce alterations in the user’s system (software and hardware), or in the electronic documents and files stored in the user’s system.

NINE: Modifications

THINK LAB reserves the right to modify, limit or cancel part or the entirety of the terms and conditions applied to the PORTAL.

TEN: User Responsibility

The user will be explicitly responsible of:

• The contents and commentaries introduced in the communications addressed to THINK LAB.

• The execution of any kind of illegal, pernicious, detrimental or right violating actions.

• Any kind of infraction on its part regarding the general conditions.

• The appropriation of distinctive signs, texts, comments and any other contents in the PORTAL.

 
 ELEVEN: Responsibility exemption

THINK LAB will not be held responsible directly or in a subsidiary manner of:

• The service quality as well as the access speed, correct functioning and/or availability or functionality of the portal.
• The information introduced by the site’s users, collaborators and third parties as well as their opinions.
• The damages that may occur in the users’ equipment because of the usage of the PORTAL.
• The veracity, precision or updating of the information.
• The non-fulfilment of the law or the terms and conditions regarding morals, and good manners generally accepted by the public order as a consequence of the transmission, diffusion, storage, reception or obtaining of access to the site’s contents.
• The links and hypertext at www.cocosuites.com that grant the user access to the services and benefits offered by third parties that are not under THINK LAB’S control. The entity won’t therefore be held responsible for the information contained or the effects derived from it.
• All kinds of vices and defects of the transmitted, divulged, stored or displayed contents.  

TWELVE: Intellectual and industrial property

The entirety of the PORTAL, that is: texts, images, logos, graphics, brands, buttons, software archives, colour combinations as well as the structure, selection, order and presentation of the site’s contents, is protected by the laws of Industrial and Intellectual Property. It is therefore prohibited to reproduce, distribute, publicly communicate or transform the contents and the information within for personal or private use whichever the finality and means for it.

LAST SECTION: Jurisdiction

The present conditions are written in Spanish and are subject to the actual Spanish legislation. Regarding any kind of controversies derived from the usage of the services offered or the contents belonging to the PORTAL, the parts, agreeing on these conditions, will be submitted to the Tribunals and Courts of Barcelona (Spain).
